1. Acceptance of Terms
These Terms and Conditions ("Terms") govern your use of the BellSill Transport LTD website located at bellsill.com (the "Website") and all freight, trucking, and logistics services provided by BellSill Transport LTD ("BellSill Transport," "we," "us," or "our"), a corporation registered in Alberta, Canada.
By accessing our Website, requesting a quote, submitting a booking, or using any of our services, you ("Client," "Customer," "you") agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Website or services.
If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.
Important: These Terms constitute a legally binding agreement. Please read them carefully and retain a copy for your records.
2. Services Description
BellSill Transport LTD provides professional freight and logistics services throughout Alberta, Canada, and cross-border routes. Our services include but are not limited to:
- General freight transportation (full truckload and less-than-truckload)
- Flatbed and heavy-haul transportation
- Refrigerated/reefer transport
- Hotshot and expedited delivery
- Last-mile logistics and courier services
- HAZMAT transportation (where certified and permitted)
- Oilfield and construction transportation
- Oversize and overdimensional load transport
- Vehicle hauling and auto transport
- Warehousing and cross-docking
- Third-party logistics (3PL) services
- Intermodal transportation
All services are subject to availability, applicable regulations, and the specific terms agreed upon in individual service agreements or booking confirmations.
BellSill Transport reserves the right to refuse any shipment that we determine, in our sole discretion, poses a safety risk, violates applicable laws, or exceeds our service capabilities.
3. Bookings & Quotes
3.1 Quote Requests
All quotes provided by BellSill Transport via our website, phone, or email are estimates based on the information provided by the Client at the time of the request. Quotes are valid for 48 hours unless otherwise stated in writing.
Final pricing may vary if actual shipment details (weight, dimensions, special requirements) differ from those provided at the time of quoting. BellSill Transport will notify the Client of any pricing changes prior to pick-up.
3.2 Booking Confirmation
A shipment booking is not confirmed until BellSill Transport provides a written booking confirmation via email. Submission of a booking form does not guarantee service availability.
The Client is responsible for ensuring all shipment details provided in the booking form are accurate and complete. BellSill Transport is not liable for delays or losses resulting from inaccurate information provided by the Client.
3.3 Pickup and Delivery Windows
Estimated pickup and delivery times are provided as a courtesy. BellSill Transport is not liable for delays caused by weather conditions, road closures, mechanical issues, border crossing wait times, or other circumstances beyond our reasonable control (force majeure events).
4. Payment Terms
4.1 Invoicing
BellSill Transport will issue invoices upon completion of service delivery. Standard payment terms are Net 30 days from the invoice date, unless otherwise agreed in a written service agreement.
4.2 Late Payments
Invoices not paid within the agreed term will be subject to a late payment fee of 1.5% per month (18% per annum) on the outstanding balance. BellSill Transport reserves the right to suspend services to Clients with overdue accounts.
4.3 Accepted Payment Methods
We accept payment via electronic funds transfer (EFT), business cheque, and other methods as agreed upon in writing. Payment details are provided on each invoice.
4.4 Disputed Invoices
Any invoice disputes must be communicated in writing to info@bellsill.com within 7 business days of the invoice date. Undisputed portions of an invoice remain due by the original payment date.
4.5 Credit Accounts
Credit account applications are subject to credit review and approval. BellSill Transport reserves the right to require advance payment or a deposit for new Clients or Clients with a history of late payment.
5. Liability & Cargo Claims
5.1 Carrier Liability
BellSill Transport's liability for loss of or damage to freight is governed by applicable Canadian transportation law, including the Transportation Act and the terms of the applicable Bill of Lading. Our maximum liability for cargo loss or damage is limited to $2.00 CAD per pound of the affected cargo unless higher declared value insurance has been arranged in advance.
5.2 Exclusions from Liability
BellSill Transport is not liable for:
- Loss, damage, or delay caused by events beyond our reasonable control (force majeure)
- Inherent vice or nature of the goods
- Improper or insufficient packing by the Client or shipper
- Acts or omissions of the shipper, consignee, or their agents
- Delays caused by customs, border inspections, or regulatory holds
- Consequential, indirect, or punitive damages of any kind
- Loss of revenue, profit, or business opportunity arising from shipment delays
5.3 Filing a Cargo Claim
Any claim for loss or damage must be filed in writing with BellSill Transport within 60 days of the delivery date (or estimated delivery date for non-delivered shipments). Claims must include the Bill of Lading number, invoice, and documentation of loss or damage. Legal action for cargo claims must be commenced within 9 months of the cause of action.
5.4 Website Disclaimer
Our Website is provided "as is" without warranties of any kind. BellSill Transport does not warrant that the Website will be uninterrupted, error-free, or free of viruses. We are not liable for any damages arising from your use of or inability to use the Website.
6. Cargo Requirements & Prohibited Items
6.1 Prohibited Cargo
BellSill Transport will not transport the following:
- Illegal substances or contraband
- Unpackaged or improperly packaged hazardous materials (unless pre-arranged with HAZMAT certification)
- Live animals (unless specifically agreed in writing)
- Human remains (without prior written agreement and all required permits)
- Firearms or ammunition (without proper licensing and documentation)
- Currency, negotiable instruments, or precious metals (without prior written agreement)
- Any cargo prohibited by Canadian federal or provincial law
6.2 HAZMAT Requirements
Clients shipping hazardous materials must provide accurate and complete documentation including Safety Data Sheets (SDS), proper labelling, and placarding as required by Transport Canada's Transportation of Dangerous Goods (TDG) regulations. The Client assumes full liability for any penalties arising from improper HAZMAT documentation.
6.3 Oversize and Overweight Loads
All oversize and overweight shipments require advance notice and approval. Permit fees, pilot car costs, and route planning charges are the Client's responsibility unless otherwise agreed in writing.
6.4 Packaging Standards
Clients are responsible for ensuring all cargo is properly packaged, labelled, and secured for transport. BellSill Transport is not liable for damage resulting from inadequate packaging.
7. Cancellation & Amendment Policy
7.1 Client Cancellations
- More than 24 hours before pickup: No cancellation fee
- 12–24 hours before pickup: 25% of quoted freight charge
- Less than 12 hours before pickup: 50% of quoted freight charge
- After driver dispatched: 100% of quoted freight charge (truck ordered fee applies)
7.2 Amendments
Changes to confirmed bookings (pickup/delivery address, date, cargo details) must be communicated as soon as possible. Amendment fees may apply depending on the nature and timing of the change.
7.3 BellSill Transport Cancellations
BellSill Transport reserves the right to cancel a booking due to equipment unavailability, safety concerns, or force majeure events. In such cases, we will notify the Client promptly and arrange a full refund of any advance payments.
8. Website Use
8.1 Permitted Use
You may use our Website for lawful purposes only — to learn about our services, request quotes, submit bookings, or contact us. You agree not to:
- Use the Website in any way that violates applicable local, provincial, national, or international law
- Attempt to gain unauthorized access to any portion of the Website or its related systems
- Transmit any unsolicited commercial communications (spam)
- Upload or transmit viruses, malware, or any other malicious code
- Use automated tools (bots, scrapers) to extract content without our written permission
- Impersonate BellSill Transport or any of its employees
8.2 Accuracy of Information
While we strive to ensure information on our Website is accurate and current, we make no warranties regarding the completeness or accuracy of any content. Service offerings, pricing estimates, and coverage areas may change without notice.
9. Intellectual Property
All content on the BellSill Transport website — including text, graphics, logos, images, icons, audio clips, and software — is the property of BellSill Transport LTD or its content suppliers and is protected by Canadian and international copyright law.
You may not reproduce, duplicate, copy, sell, resell, or otherwise exploit any portion of our Website content without our express written permission. The BellSill Transport name, logo, and related marks are trademarks of BellSill Transport LTD.
10. Indemnification
You agree to indemnify, defend, and hold harmless BellSill Transport LTD and its directors, officers, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable legal fees) arising from:
- Your use of the Website or our services
- Your violation of these Terms
- Your violation of any applicable law or third-party rights
- Inaccurate or incomplete information you provided in connection with a shipment
- Improper packaging or preparation of cargo
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any legal proceedings arising from or related to these Terms or our services shall be instituted exclusively in the courts of Alberta, and you consent to the personal jurisdiction of such courts.
12. Dispute Resolution
We encourage Clients to contact us directly to resolve any concerns before pursuing formal legal action. Most disputes can be resolved quickly and amicably through direct communication.
If a dispute cannot be resolved through direct negotiation within 30 days, the parties agree to submit the dispute to non-binding mediation in Edmonton, Alberta before initiating litigation. The costs of mediation shall be shared equally between the parties.

13. Changes to These Terms
BellSill Transport reserves the right to modify these Terms at any time. Changes will be effective upon posting the revised Terms to our Website. The "Last Updated" date at the top of this page reflects when the Terms were most recently modified.
Your continued use of our Website or services after any changes constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using our Website and services.
We will make reasonable efforts to notify existing Clients of material changes to these Terms via email.
